Environmental Noise

The European Court of Justice has held that the UK failed in its obligations under the Environmental Noise Directive 2002/49/EC by failing to transpose the Directive into national law by 18th July 2004. The Commission issued a Reasoned Opinion to this effect on 13th July 2005, giving the UK two months in which to take measures to comply with the Directive.

The UK failed to do so, and in fact only implemented the Directive in October 2006, through separate legislative instruments for each devolved administration. In was therefore held to have failed in its obligations under the Directive.
