Commission v Spain

Spain has been found to be in breach of Directive 79/409/EC on the conservation of wild birds. The European Court of Justice opined that in failing to classify sufficient special protection zones for the species of birds designated in Annex I to the Directive and for migrating species of birds not specified in the Annex in the autonomous communities of Andalucia, the Balearics, the Canary Islands, Castilla-La Mancha, Catalonia, Galice and Valence, and in classifying insufficient areas in Andalucia, the Balearics and the Canary Islands, Spain had breached paragraphs 1 and 2 of Article 4 of the Directive.
