Commission v Austria

Environmental Noise

The ECJ has passed judgement in a case involving Directive 2002/49/EC on environmental noise. It held that in failing to take within the prescribed time the necessary legislative, regulatory and administrative measures to transpose Directive 2002/49/EC in respect of the Länder of Burgenland, Carinthie, High-Austria, Salzburg, Styrie and the Tyrol, Austria failed in its obligations under the Directive.

The Commission had issued a reasoned opinion, inviting Austria to take the necessary measures to transpose the Directive within two months from that date of the opinion, but this was not done.
