The European Court of Justice has rejected appeals by the Austrian government and the Upper Austria region against the 2005 ruling condemning their ban on growing genetically modified crops.

In refusing the appeal EU judges stated the national and regional governments had failed to provide convincing evidence that the ban was justified under article 95 of the EU treaty.
