In a ruling, projected to have significant implications for the waste management industry, the Court of Appeal has upheld a High Court decision that a landfill permit may be granted pursuant to the Landfill Regulations for the operation of a separate landfill which partially overlies a closed cell containing previously deposited waste (a so called piggyback landfill).

The Court of Appeal went further, in that it quashed the previous declaration of the high court which stated that a PPC permit could not be granted if an old landfill underneath was leaking leachate into groundwater.
