Possible future legal challenges

Moray Council announced this month that it intends to take the Scottish Executive to court, by way of an action for judicial review of its decision to grant approval for a controversial wind-farm development near Keith in the north of Scotland.


Following the rejection by Moray Council of the application by Renewables Energy Systems for a 21-turbine farm to be located on the Hill of Towie, at Drummuir, near Keith, this was overturned when the developer appealed and a public enquiry was held.


This will be the first time the Scottish Executive is taken to court regarding a wind-farm application, with Moray Council claiming the Reporter’s decision to have been “fatally flawed” with too much emphasis having been placed on the Executive’s advice regarding national policy of the need for wind farms.
