Esos phase 1 compliance – join the amnesty
16 November 2017, News release from Utilitywise
Have you received an enforcement notice for Phase 1 ESOS compliance? Take action today. Sign up to the Utilitywise ESOS amnesty to start your compliance journey.
Many companies are still yet to comply with the Energy Savings Opportunity Scheme (ESOS), so how can they get ESOS help? We’re calling on the Environment Agency (EA) to support our ESOS amnesty.
You may have missed the ESOS Phase 1 compliance deadline, never got round to submitting your ‘Intent to Comply’ by 29 January 2016, and didn’t manage to hit the ‘unofficial’ compliance deadline by 30 April 2016. Now you have an enforcement notice on your doorstep – and you’re not the only one.
Even after all the ESOS Phase 1 deadline extensions, the EA confirmed earlier this year that there were still 500 organisations that should have complied but had so far failed to engage. At that time, the EA had already served 300 enforcement notices to bring those organisations into compliance. More are on the way.
Compliance is being enforced – take action
In a worst-case scenario, fines can be:
- Failure to undertake an energy audit: £50,000 plus £500 per day for a maximum of 80 days, plus;
- Failure to comply with a compliance notice, an enforcement notice or a penalty notice: £50,000 plus £500 per day for a maximum of 80 days.
We can proudly say we helped over 270 ESOS Phase 1 clients avoid combined penalties of over £48,000,000*.
You’re at a greater risk of fines if you ignore an enforcement notice. The good news is it’s not too late to take action – start working towards compliance now.

If your business still needs to make a start with ESOS compliance, we’re here to help. Our dedicated team of ESOS Lead Assessors and highly trained Energy Auditors will work hard to help you comply as soon as possible, and support you in any conversations with the EA.
In the ultimate worst-case scenario, non-compliant companies could face fines, injunctions, civil actions, or prosecution. Is it worth the risk, when it’s so easy to get started? There’s really nothing to lose. By contacting us today we can open a dialogue with the EA, showing your willingness to comply.
Seize your ESOS opportunity
ESOS isn’t a simple tick-box exercise. It’s a real chance to improve the efficiency of your business and make significant cost savings.
On average we found savings of three times the cost of compliance for our Phase 1 clients, with an average of 18% kWh savings per organisation. In total, we identified 2.3 million tonnes worth of CO2 savings – the equivalent of 1,138 Wembley Stadiums full of carbon!
