Access to Environmental Information

The ECJ has issued a judgement against Austria for failing to transpose within the prescribed time the provisions of the Public Access to Environmental Information Directive.

The Austrian Government stated that many of the Länder were still in the process of transposing the legislation at a federal level. The authorities recognised that they had failed to fulfil their obligations in respect of these Länder, but they made reference to the fact that other Länder (namely, Carinthie, High-Austria, Styrie, the Tyrol and Voralberg) had fully transposed, or were in the process of transposing the legislation.

The ECJ stated that Austria were still in breach of its obligations as the Directive was yet to be fully transposed.
