Environmental Noise
The European Court of Justice has found that Luxembourg failed to transpose Directive 2002/49/EC within the prescribed time, thereby failing in its obligations under that Directive. Transposition should have taken place by 18 July 2004.
After the Commission issued a reasoned opinion, Luxembourg indicated that a bill transposing the Directive would be subjected to a vote in Parliament by the end of 2005, but since the Directive was not transposed within the period of two months set out in the reasoned opinion the court had no choice but to declare Luxembourg to have failed in its obligations.
