The case concerned breaches of obligations under the Waste Framework Directive (Directive 75/442/EEC) following allegations by the Commission that within Greece, 1458 unlawful and uncontrolled waste tips were in operation, receiving waste from 47% of the country’s population.

As the Greek authorities had advised the Commission that the necessary programme to reduce unlawful and uncontrolled waste disposal sites and their replacement with lawful landfill sites would only be completed at the end of 2007, the Commission was of the view that by allowing unlawful and uncontrolled sites to operate on its territory, the Hellenic Republic was in breach of its obligations under Articles 4, 8 and 9 of the WFD.

The Court held that by failing to transpose the requirements of Article 4, 8 and 9 of Directive 75/442/EEC, Greece had failed in its obligations under the Directive.
