Energy Tax

The European Court of Justice condemned Italy for its failure to comply with EU rules on energy taxation. Under these rules Member States must seek permission from the European Commission before they can grant rebates to companies on energy taxes.

The Court stated that in failing to adopt the necessary legislative, regulatory and administrative measures to comply with Directive 2003/96/EC restructuring the Community framework for the taxation of energy products and electricity, Italy had failed in it’s obligations under that Directive.
