Public participation and access to justice

The European Court of Justice (ECJ) has upheld a complaint lodged by the European Commission that the UK failed to implement, within the prescribed period, EU laws arising from the Aarhus Convention, requiring public participation in respect of environmental decision-making and access to justice in environmental matters.

Under Article 6 of Directive 2003/35/EC providing for public participation in respect of the drawing up of certain plans and programmes relating to the environment, national transposition measures were to have been introduced by 25 June 2005, which the UK had failed to do. The UK therefore acknowledged the action as well founded. However, it informed the Court that transposition was now underway and would be completed in the very near future.
