The CRC, while aiming to a simple scheme, has several complex aspects that many organisations are struggling to understand.

One facet of this is that a large number of those who will be required to fully participate in the CRC are not currently subject to, or necessarily familiar with, emissions trading legislation.

In this seminar, Burges Salmon will highlight a number of key legal issues arising from the scheme.

These include defining the corporate structure under the scheme, including nomination of primary members and the possible disaggregation of significant group undertakings; the significance of property holding arrangements; commercial and transactional implications; and determining emissions responsibility based on definitions as updated following the Government’s response to consultation.
