Ireland breaches EIA Directive

The European Court of Justice (ECJ) has found Ireland to be in breach of EU law by failing to adequately transpose the Environmental Impact Assessment (EIA) Directive (85/337/EC).


The Court held that Ireland had not adopted the legislative measures necessary to ensure that projects relating to the restructuring of rural land holdings; the use of uncultivated land or semi natural areas for intensive agricultural purposes; irrigation and land drainage projects; and, intensive fish farming were made subject to a development consent and an environmental impact assessment.
