Italy lacks waste plans

Italy has been told it must draw up waste plans for all of its regions, as they are currently missing in five provinces.

Waste Management Plans

The European Court of Justice (ECJ) gave judgement this week in the case of Commission v Italy (Case C-82/06), in which it was alleged that Italy had failed to fulfil its obligations under Article 7(1) of the Waste Framework Directive (Directive 75/442/EEC) and Article 6 of the Hazardous Waste Directive (Directive 91/689/EEC) by failing to draw up or communicate waste management plans for a number of its provinces.

The Italian provinces in which the breaches occurred were Rimini, Lazio, Friuli Venezia-Giulia and Puglia and Bolzano Alto-Adige. The Court has agreed with the allegations of the Commission against Italy, holding Italy to be in breach of the above Article provisions, and liable to pay the costs of the action.

The judgement of the Court is available in French here.
