The Court held that Ireland had not adopted the legislative measures necessary to ensure that projects relating to the restructuring of rural land holdings; the use of uncultivated land or semi natural areas for intensive agricultural purposes; irrigation and land drainage projects; and, intensive fish farming were made subject to a development consent and an environmental impact assessment.
