Important news update on ESOS Phase 3

An announcement on ESOS reforms for Phase 3 was expected to have been published by now, but we have learned that the results of the consultation and the requirements of compliance are not likely to be published until July 2022 at the earliest. Despite the delays, the deadlines for compliance have not changed and so JRP have compiled some information about what we do know, what we anticipate will be included, and what you can be doing now to prepare. Read on for more information.

We anticipate that private organisations with over 250 employees and/or €50m are still likely to be required to undergo compulsory energy audits by qualified auditors. We also anticipate that there may be exclusions depending on level of energy usage and that there may be more onus on organisations to deliver energy saving opportunities identified and to incorporate these into a Net Zero Greenhouse Gas Emissions plan. It will be even more important to choose a well-qualified, experienced ESOS auditor.

Despite the delay in details of Phase 3, the deadlines for audit completion will not change:

  • Phase 3 audits will be required to be completed and reports submitted to the Environment Agency by 5th December 2023.
  • Organisations will be required to comply based on their situation (number of employees/turnover) on 31st December 2022.
  • Twelve months’ energy data used in the ESOS audit must begin no earlier than 12 months before start of the compliance period, ie no earlier than 1st January 2022

What can you do to prepare? The biggest challenge to completing ESOS audits on time is collation of data.
