The ECJ upheld a complaint by the Commission that, by authorising an irrigation project in the irrigable area of the Segarra-Garrigues Canal, Spain failed to fulfil its obligations under Article 4(4) of the Birds Directive to take appropriate measures to avoid, in an area which ought to have been classified as a Special Protection Area, prohibited disturbances.
